    MANY articles have been written about buying a house and the problems involved. A reader has asked that the subject of land purchase as distinct from buying a house be discussed. Of course buying a house also involves buying land. Similar principles are involved.

    COMPLETION dates are important in contracts for the construction of buildings and other structures. A person who has engaged a contractor to construct a building will want an assurance when the structure will be completed and handed over.

    LAND is a precious and valuable asset. If the landowner were to stand on his plot of land and look towards the horizon he may ask himself how far his rights extend. It is relevant to examine the provisions of the law in the National Land Code. The definition of land is provided in Section 5 of the Code.

    AN ARTICLE I wrote about completing projects on time has prompted a reader to come up with comments and questions on the absence of terms in a contract which can give rise to disputes. The reader poses the question whereby a contract agreement stipulates for a completion period of a project as within three months but it does not indicate clearly the commencement and completion dates. It also does not incorporate provisions for extension of time.

    PROPERTY buyers must understand the transaction that they are entering into and exercise diligence. Some buyers may find this rather troublesome and may opt for the more convenient way of signing what is perceived to be a standard agreement and hope that all will go well. Often it does but when it does not, the headache starts.
     
  7. Time to take action

    MANY house buyers must place great hope in the announcement on changes in the law regulating housing development. Some see it as a new law on the subject. Though the Act has a different name, it is not an entirely new Act. It is the existing Act which has been amended. And this amendment includes a change to the name of the Act while also creating a tribunal that will deal with some of the woes of the house buyer.
     
  8. The right of banks

    LAST week we discussed the position of a buyer of a piece of land which was part of a larger plot of land. That larger plot of land is being developed and after most of the purchase price had been paid, receivers and managers stepped in and the land sold off with the money used to pay the financial institution.

    A NOTICE and demand look fairly ordinary at first glance and sometimes they are treated as if they are synonymous. Yet they are not because a notice is frequently used to make a demand though it is also used in many other situations.

    BUSINESS organisations and corporations, just like individuals, are always entering into contracts. Unlike individuals, such corporations are created for the very purpose of engaging in business transactions.
