Remove loopholes in law
NST 31/05/2006

THE fiasco concerning the Menara Matrade is becoming more complicated, especially so when it was announced by the Works Minister that it may be impossible to bring to justice Perangsang International Sdn Bhd (PISB), as the company has been bought over by another party.

Therefore, the company does not exist anymore and no law suits can be brought against it.

If this is true then there must be something wrong with the company laws in Malaysia.

If it is so easy for a company to get away from prosecution knowingly or unknowingly, by selling itself off to another party, then Malaysian companies with similar problems may do just that in order to avoid prosecution.

One may be able to do it to a company just like that but what about the persons involved in it?

The wrongdoings of these companies are committed by the people owning and running them.

If the company laws of Malaysia do not allow prosecution against companies that cease to exist after they are bought over by other companies, before long there will be lots of companies for sale or takeover in order to avoid prosecution.

If such laws exist then they should be abolished.
