Sabah State Assembly Passes Housing Tribunal Bill

KOTA KINABALU, Dec 9 (Bernama) -- The Sabah Legislative Assembly Friday passed the Housing (Control and Licensing of Developers) Enactment (Amendment) 2005, which among others will facilitate the setting up of a tribunal for house purchasers claims.

State Local Government and Housing Minister, Datuk Hajiji Noor when tabling the amendment said the proposed legislation sought to ensure that the state's housing industry continued to expand in a structured and orderly manner by tightening up control on irresponsible developers.

The tribunal will have at least five members including the chairman and deputy chairman.

Under the legislation, a house buyer can file a complaint against the developer on any breach of the sale and purchase agreement within 12 months after the issuance of the certificate of fitness or before the end of the defect liability period as stated in the agreement.

Hajiji said the bill also introduced a new section to prevent developers from withdrawing money from the Housing Development Account beyond what was permissible.-- BERNAMA
