Dissatisfied buyers given an option

BUYERS of Taman Fadason, who have submitted their claims for late delivery of their units to the Housing Tribunal (HT), have been given the option to choose between off-setting their claims against the monthly maintenance fees for three years or wait for the HT to act on their behalf. 

An ad-hoc committee is dealing with the matter over the new medium-cost apartments in Taman Fadason in Jinjang Utara. 

A total of 350 claims have been submitted to the HT and some 34 house-buyers have been compensated since April.  

Fadason Holdings Sdn Bhd began the project in June 1999, but did not complete it within the stipulated three years.

Buyers had to pay interests on their bank loans for the delay. Those affected are buyers of homes in blocks D,E and F. Of the 720 units only 50% of the buyers have submitted their claims. Kepong MCA pulic services and government affairs bureau chairman Yee Poh Ping, who is also adviser to the committee, said the affected residents had been given a choice.  

“They can either submit their claims to the HT or off-set their claims through the maintenance fees,” he said. 

The tribunal entertains only claims below RM25,000 and so far those received ranged from RM2,000 to RM4,200. 

“There is a mixed reaction to the offer as some buyers feel they will be at the receiving end if they off-set their claims,'' said Yee.  

A buyer claimed that as per the Sales and Purchase Agreement, buyers should only pay RM180 in maintenance fees over three years. “But, the developers have claimed that there was a mistake in the agreement and that the fee should have been RM60 per month instead,'' he said. 

Yee said since there was a misinterpretation in the agreement, this would be dealt as a separate issue. “For now, dissatisfied buyers, including those from blocks A, B and C, have been urged to submit their claims to the tribunal.''  

These blocks comprise 1,080 units.
