Taman Fadason folks turn to tribunal

THE ad hoc committee dealing with claims on late delivery of the newly-completed medium-cost apartments at Taman Fadason in Jinjang Utara recently submitted 332 sets of claims from the residents to the Housing Tribunal.

The committee is now waiting for hearing date from the tribunal, which is based in Pusat Bandar Damansara.

Kepong MCA public service and government affairs bureau chairman Yee Poh Ping, who is also the adviser to the committee, said residents of the apartments who missed the submission deadline could file their claims separately with the tribunal.

He said those having a problem doing so could submit their claims to staff at the Jinjang MCA building.

He said the claimants would have to pay a fee of RM10 to the tribunal for each claim they make.

According to filling procedures, the claimant has to register his case by filling out Form 1 in four copies along with an attachment of the claims and the fee.

After that, the claimant has to send a copy of the form to the developer has to file its defence with Form 2 (four copies) along with a fee of RM10 within 14 days after receiving Form 1.

Yee said the committee was told that the tribunal only had a working president who was chairing the hearing, adding that it was foreseen that there would be backlog considering the present processing pace.

He urged the Housing and Local Government Ministry to speed up the appointment of the other tribunal committee members so that the proceeding would be expedited.

Yee also encouraged the public to make use of the tribunal for claims related to housing issues.

Meanwhile, on the offer by the developer on the liquidated damages for late delivery, he said the claimants were not damages for late delivery, he said the claimants were not satisfied with the developer's offer of 50% of the total liquidated damages as well as with the fact that they would have to wait for another eight months to receive the stated sum.

The tribunal is located on the second floor of Block B Selatan, Pusat Bandar Damansara, 50782 Kuala Lumpur.
