Condo purchasers to lodge report against developer

Nearly 25 purchasers of the Venice Hill Condominium and Golf Resort's Tower 10 units have unanimously agreed to lodge a police report next week against the developer, Venice Hill Resort Living Sdn Bhd. (VHRL), for criminal breach of trust.

VHRL is a member of the Li Foong Group of Companies.

Tower 10 which comprises over 300 condominium units have yet to obtain its building plan approvals.

Although some of the buyers have purchased units in the development as far back as 1995, to date they are yet to receive vacant possession of their units.

Up to 80 per cent progress payment has been released to the developer for the tower which is virtually completed.

The residents are running out of patience and are determined to compel the developer to complete the building and to take all necessary action to legalise the tower.

Last month a spokesperson from the Kajang Municipal Council had told NST that the Council was not willing to talk on the issue of legalising Tower 10 due to the fact that the developer was unable to show proof that the land conversion fee from agricultural to residential development had been paid.

She added that there was however a fine of RM452,296.60 to be paid to legalise Tower 9, which also does not have building plan approvals despite being completed and is presently 25 per cent occupied.

Two weeks ago a purchaser of Tower 10 produced a letter from the council dated March 22 stating that at the council's building plan sub-committee meeting held on Dec 14 last year, it was decided that Tower 10 would be legalised on condition that the developer pay a fine of RM465,877.60.

Currently all the documents pertaining to the purchase of the Tower 10 units by the buyers are being complied and would be handed over to a lawyer to make the police report.

"We are also planning civil action with the intention of exerting pressure on the developer to complete Tower 10," said purchaser Thomas Oh.

"We also plan to involve all the banks that had provided financing to the purchasers of Tower 10 to jointly work with us to see how best to resolve the matter," he added.
