PROPERTY TRANSACTION FEES & DUTIES

A. Legal Fees for Sale and Purchase Agreement

Legal fees for drawing up the Sale and Purchase and completion of transfer/assignment depends on the property value as set out in the Sales and Purchase Agreement or the market value as determined by Valuation Department. The legal fee/solicitor's remuneration chargeable by any law firm is fixed under the Legal Profession Act.

Legal fees for purchase of a completed unit from individual/ public auction/ developer etc

  Value of property Legal fees
i. 1st RM100,000 1% of property value
ii. Next RM4.9million 0.5% of property value
iii. Thereafter 0.25% of property value
The formula for calculating the above fee for property below RM4.9mil is as follows:
Property Price x 0.5% + RM500.00 = Legal fee.
Stamping charges
RM10.00 per copy

Legal fees for purchase of a yet-to-be completed unit from developer with a standard S&P Agreement

  Value of property Legal fees
i. Below RM30,000 (and provided classified as 'low-cost') RM120
ii. RM30,001 - RM100,000 1% less 25%
iii. 1st RM100,000 1% of property value
iv. Next RM4.9 million 0.5% of property value
v. Next RM5 million 0.25% of property value
vi. Next RM10million

Negotiable but not exceeding 0.25% of the excess amount of RM10 million

Stamping charges
RM10.00 per copy
Legal fees for Loan Documentation

For purchase of a completed unit from individual/ public auction/ developer etc

Principal Instruments (Loan Agreement):
  Loan sum Legal fees
i. 1st RM100,000 1% of loan sum (min RM200)
ii. Next RM4.9million  0.5% of loan sum
iii. Thereafter 0.25% of property value
For purchase of a yet-to-be completed unit from developer with a standard S&P Agreement
  Loan sum Legal fees
i. Below RM30,000 (and provided classified as 'low-cost' RM120
ii. RM30,001 - RM100,000 1% of loan sum less 25%
Stamping charges
RM10.00 per copy of agreement

C. Stamp duties

Stamp Duty for transfer of Property - Memorandum of Transfer/Deed of Assignment
When a property is transferred/assigned, Stamp Duty is borne by the transferee/assignee.
Stamp duty is based on:
  • the price paid for the property or its market value, whichever is the higher. This is provided for under the First Schedule to the Stamp Act, 1949.
  • The material date of valuation is the date of execution of the Sale and Purchase Agreement, otherwise it is the date of the execution of the instrument of transfer/assignment.
  Value of Property Stamp Duty
i. On the first RM100,000: 1%
ii On any amount in excess of RM100,000 but not exceeding RM500,000: 2%
iii On any amount in excess of RM500,000 3%

(g) Lodgement Withdraw of Lien-holders caveat : RM80.00 (Selangor).

Charge
(a) Registration of charge : RM50.00 (Selangor)
(b) Stamp duty on charge : RM5.00 for every RM1,000.00 of the loan amount or 0.5% of loan amount.
(c) Stamp duty on copies of charge : RM10.00 flat per copy

Stamp duty for Loan Agreement
Loan Agreement
(a) Stamp duty : RM5.00 for every RM1,000.00 of the loan amount or 0.5% of loan amount
(b) Loan Agreement with Power Of Attorney clause : additional RM10.00
(c) Registration of Power of Attorney at High Court : RM1.00 per printed page
(d) Stamp duty on copies of Loan Agreement : a flat RM10.00 per copy
 
Stamp duty for Deed of Assignment
Stamp duty : Nominal at RM10.00
